Cancer

Work/Life/Cancer Balance

I got prostate cancer. The doctor told me that my last shot of my treatment was last April 2014 and I'm going back to the doctor for blood test and evaluation on Sept. 2014. I've been working from this company for about 10 years and they just laid me off just today. I thought I'm protected from getting laid off from my job if you have cancer. I have no issue with the company. I believed I did a good job with the company. I work at the shipping department and I'm the one who trained all that is working right now at the shipping department. They laid off few people today. I think I got laid off from job in my department because I got cancer which I could still function for my job. I even argued to my boss that why I got laid off not the  guy whom I trained to do the job. The guy that is left there now is physically stronger than I do. Is there any discriminatory act the company did to me? Please advice. I really need a job. I got 3 kids and my wife is not working. Please advice. Thank you.

The other guy that left on my  department spent too many hours at the rest room doing nothing and the supervisor knew about it that's why  I feel there's a discrimination on my part.

Hi Joseph,

Thanks for writing to us! I have sent your question to one of our legal experts who will be in touch soon.

In the meantime, I would recommend reaching out to the National Cancer Legal Services Network: http://www.nclsn.org/

Cancer and Careers Staff Comment:

Dear Joseph,

Thanks again for reaching out! We have discussed your situation internally and
feel that you should consult a lawyer individually about your situation with
your previous employer to make sure you get the targeted guidance this situation
requires. Unfortunately, we don’t have the ability to provide direct legal
services, however there are many local and national organizations that do.
Check out www.nclsn.org and
www.lawhelp.org to start.

To get some more information on the laws that may be relevant to
your situation visit: www.cancerandcareers.org/en/at-work/Legal-and-Financial/Cancer-and-the-ADA-FMLA
and triagecancer.org/resources/stateresources/.

As far as looking for a new job, we offer many resources to help
you do so:

First, check out our “Looking for Work” section of our website.
It offers lots of information about networking, resumes, and interviewing. You
can also download or order a free copy of our Job Search Toolkit here: www.cancerandcareers.org/publication_orders/new

Second, I would suggest submitting your resume to be reviewed
for free by our career coach here: www.cancerandcareers.org/resume_reviews/new

Lastly, we also recommend the website www.flexjobs.com. It is a professional job
service to help you find the best flexible jobs available, safely and easily.
Every job is hand-screened and legitimate. FlexJobs offers a 50% discount on
membership fees for Cancer and Careers constituents—just type
"CANCER" into the promo code field during payment.

Best,

Kelsey
